1. ORTON Bath & Shower Sets 5-Years Limited Warranty

Orton warrants its Bath& shower sets to be leak and drip free during normal residential use for as long as the original consumer purchaser owns his or her home. If the Bath& shower sets should leak or drip during normal use, Orton will, free of charge, mail to the purchaser the cartridge necessary to put the Bath& shower sets in good working condition.

Orton also warrants all other aspects of the Bath& shower sets or accessories (“Bath& shower sets”) to be free of defects in material and workmanship during normal residential use for as long as the original consumer purchaser owns his or her home. If a defect is found in normal residential use, Orton will, at its election, repair, provide a replacement part or product, or make appropriate adjustment. Damage to a product caused by accident, misuse, or abuse is not covered by this warranty. Improper care and cleaning will void the warranty. Proof of purchase (original sales receipt) must be provided to Orton Distributor with all warranty claims. Orton is not responsible for labor charges, installation, or other incidental or consequential costs. In no event shall the liability of Orton exceed the purchase price of the Bath& shower sets.

If the Bath& shower sets is used commercially，Orton warrants the Bath& shower sets to be free from defects in material and workmanship for Five (5) year from the date the product is installed.

This is ORTON’s exclusive written warranty.

**Never use cleaners containing abrasive cleansers, ammonia, bleach, acids, waxes, alcohol, solvents or other products not recommended for chrome. This will void the warranty.

** Any damage caused by improper installation is not covered by this warranty.

2. ORTON Bathroom Vanity One-Year Limited Warranty

ORTON offers the following limited warranty on each of its vanity products (the “Product”) and the components thereof. This warranty extends only to the original owner or end-user for personal household use. This warranty is void if the product has been moved from its initial place of installation. For commercial uses, additional limitations apply. ORTON warrants the product to be free from defects in workmanship and materials under normal use and service for a period of one (1) year from the initial date of purchase by the owner or end-user, contractor, or builder, from ORTON or an authorized ORTON dealer unless otherwise noted. Subject to the warranty service provision below, any product reported to the authorized dealer or to ORTON as being defective within the warranty period will be repaired, or replaced with a product of equal value at the discretion of ORTON. This warranty extends to the original owner or end-user and is not transferable to a subsequent owner. Neither the distributor, authorized ORTON dealer, nor any other person has been authorized to make any affirmation, representation, or warranty other than those contained in this warranty. Any affirmation, representation, or warranty other than those contained in this warranty shall not be enforceable against ORTON or any other person. This warranty shall not apply to instances of incorrect operating procedures, breakages, or damages caused by fault through improper installation, carelessness, abuse, misuse, misapplication, improper maintenance, or alteration of the product, as well as chemical or natural corrosion, accident, fire, flood, an act of God, or any other casualty. Avoid abrasive cleaners, steel wools, and harsh chemicals as these will scratch, damage, and / or dull the product and / or finish and void this warranty. The owner/end-user of the product covered by the present warranty is entirely responsible for its proper installation and any applicable plumbing. ORTON neither installs nor supervises the installation nor hires a contractor for this purpose; consequently, ORTON cannot be held responsible for any default, breakage, or damages caused thereby or resulting thereof, either directly or indirectly. The owner/end-user must provide access to the components of the Product as described in the installation guide so that ORTON can execute the warranty specified herein. If such access is not available, all expenses to provide said access will be the responsibility of the owner/end-user. This warranty does not apply to local building code compliance. The owner/end-user should check with the local related plumbing codes before installation. This warranty does not apply to products that have not been installed or operated in accordance with instructions supplied by ORTON and all applicable rules, regulations, and legislation pertaining to such installations. This warranty does not apply unless the ORTON Product is installed by fully insured licensed professionals. ORTON strongly recommends that such licensed professionals have experience in the installation of bathroom products. Installation of certain products, including, without limitation, glass products (i.e., glass countertops glass sinks) by an inexperienced person may result in glass breakage and, consequently, cause personal injury or death. ORTON is not liable for personal injuries or deaths to any persons or for any direct, special, incidental, or consequential damage, loss of time, loss of profits, inconvenience, incidental expenses, labor or material charges, or any other costs resulting from the use of the product or equipment or pertaining to the application of the present warranty, or resulting from the removal or replacement of any product or element or part covered by this warranty. Except as otherwise provided above, ORTON makes no warranties, expressed or implied, including warranties of merchantability and fitness for a particular purpose or compliance. In any case, ORTON cannot be held liable for any amount over and above the purchase price paid for the Product by the owner/end-user, contractor, or builder. ORTON products are made of naturally variable raw materials. Differences in grain character and color among wood and plant species and stones and minerals are naturally occurring variations and are not within the control of the manufacturer nor considered defects under this warranty. Natural color changes, variations, or movements in lumber or veneer products, and exposure to extreme temperature changes and direct sunlight, may cause color changes and/or surface damage and are not covered by this warranty. All wood naturally ages, darkens, changes in color, and mellows over time due primarily to exposure to light. While this color change is imperceptible from day to day, it may be significant over a longer period of time, or due to amount of light the wood is exposed to. On warranty replacement doors or drawers, we will not guarantee an exact color match. Imperfections such as checks (small surface splits), pitch pockets (small dark holes) or darker mineral streaks are natural and are not considered defects. Surface characteristics of natural stones may vary from each slab. Color variations in stone are a natural occurrence. Natural veining, crystal lining and local crystallization are common characteristics of natural stones. For this reason, new and/or replacement pieces may not match display samples and/or existing pieces. Natural occurring stone characteristics such as variation in grain, color, mineral streaks are not considered defective product. In addition, all ORTON vanities are handcrafted. Each product may vary slightly in size and color within an acceptable industry tolerance. Due to the manufacturing process, tempered glass will tend to have a greenish tint. This is a natural feature and is not considered a defect. As a result of the tempering process or otherwise, color variation in glass may occur in certain products. ORTON reserves the right to modify this warranty at any time, it being understood that such modifications will not alter the warranty conditions applicable at the time of sale of the products in question.

3.ORTON Bathtubs 5-Year Limited Warranty

ORTON offers the following express limited warranties on its products. These warranties extend only to the original owner/end-user for personal household use and start from the manufacturing date of the unit. For commercial uses, additional limitations apply. A proof of purchase is mandatory to proceed with any warranty claims.

It is the responsibility of the owner/installer to inspect any ORTON Acrylic product prior to installation. Should inspection reveal any damage or defect in the finish, Contact Us. The warranty does not cover damages or defects in the finish once the unit has been installed.

This limited warranty, starting on the original purchase date, is only offered to the original purchaser who acquires the product directly from authorized ORTON dealers. This limited warranty does not apply to cases in which a product was incorrectly installed, nor to damage due to negligence, misuse, thermal shocks, cigarette burn, fire, natural disasters or other accidents.

ORTON ACRYLIC- Acrylic: ORTON Acrylic, Acrylic skirted & drop-in bathtubs and shower bases are warrantied for residential use for a period of 5 years from the original purchase date, against any failure from improper manufacturing defects.

ORTON ACRYLIC- Freestanding Acrylic Bathtub: ORTON Acrylic, Acrylic Freestanding bathtubs are warrantied for residential use for a period of 5 year from the original purchase date, against any failure from improper manufacturing defects.

ORTON – Solid Surface Freestanding Bathtub: ORTON solid surface products are warrantied for residential use for a period of 5years from the original purchase date, against any failure from improper manufacturing defects.

The warranty does not extend to:

Damage caused by cleaning, maintenance, or installation performed other than strictly in accordance with the information contained in the Instructions.
Damage caused by the use of strong chemicals.
Gloss reduction, scratching, or staining of the finish over time due to water impurities or atmospheric conditions.
Damage due to installation error, product neglect, misuse, or abuse, accident, or negligence, whether caused by the purchaser, a contractor, or a service provider, or any other cause beyond the control of ORTON.

In order to obtain service provided under this warranty during regular business hours, contact the dealer or distributor who sold the unit, or ORTON directly.

Please be sure to provide all pertinent information regarding your claim, including a complete description of the problem, the model name and number and color finish of the product, and the date and place of purchase. Also include your original invoice. In order to assess any claim, we may have to inspect the product as installed before removal and must be provided with access to the product upon request. Except as provided herein, seller makes no warranty of any kind, express or implied, with respect to the product, its merchantability, or fitness for a particular purpose. Seller shall not be responsible for any indirect, incidental, or consequential damages resulting from the delivery, installation, or use of the product.

ORTON will provide the warranty service described above when the following conditions have been met:

The failure is of the nature or type covered by the warranty
The user has informed an authorized ORTON Agent or Warranty Service Department representative, of the nature of the problem during the warranty period
Conclusive evidence (e.g., proof of purchase) is provided to the foregoing by the user proving that the failure occurred or was discovered within the warranty period
An authorized independent service person or company representative has been permitted to inspect the product during regular business hours within a reasonable time after the problem was reported by the user.

ORTON’s warranty obligation shall be discharged upon tender of replacement or repair. The purchaser refusal to accept the tender terminates ORTON’s warranty obligation. Any product replaced or repaired during the warranty period will be covered during the remaining period of the original warranty. In no event shall the Seller’s liability under this warranty exceed the cost of repair or replacement of the product or the purchase price of the product.

ORTON is not responsible for costs and claims that may arise from purchase of a product unsuited to the structure of the existing building. Any transformation or alteration made to a ORTON product automatically voids the warranty. The manufacturer’s warranty is limited to repair or replacement (with a ORTON product of equal value), provided the claim is made to an authorized dealer or directly to ORTON within the warranty period. Labour costs and any other expenses entailed by replacement of a ORTON product are not covered by the warranty. And does not include any cost of removal, reinstallation, transport and shipping of defective product, loss of time, salary or any other expenses as well as any consequential damages of any kind. ORTON and its representatives shall not be liable for any injury, loss, cost or other damage, whether direct, consequential, incidental, or special that arise from any defect covered under this limited warranty.

4. ORTON Faucet 5-Year Limited Warranty

Orton warrants its Faucets to be leak and drip free during normal residential use for as long as the original consumer purchaser owns his or her home. If the Faucet should leak or drip during normal use, Orton will, free of charge, mail to the purchaser the cartridge necessary to put the Faucet in good working condition.

Orton also warrants all other aspects of the faucet or accessories (“Faucet”) to be free of defects in material and workmanship during normal residential use for as long as the original consumer purchaser owns his or her home. If a defect is found in normal residential use, Orton will, at its election, repair, provide a replacement part or product, or make appropriate adjustment. Damage to a product caused by accident, misuse, or abuse is not covered by this warranty. Improper care and cleaning will void the warranty. Proof of purchase (original sales receipt) must be provided to Orton Distributor with all warranty claims. Orton is not responsible for labor charges, installation, or other incidental or consequential costs. In no event shall the liability of Orton exceed the purchase price of the Faucet.

If the Faucet is used commercially，Orton warrants the Faucet to be free from defects in material and workmanship for Five (5) year from the date the product is installed.

ORTON AND/OR SELLER ARE PROVIDING THESE WARRANTIES IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ORTON AND/OR SELLER DISCLAIM ALL LIABILITY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. Some states/provinces do not allow limitations of how long an implied warranty lasts or the exclusion or limitation of such damages, so these limitations and exclusions may not apply to you. This warranty gives the consumer specific legal rights.

This is ORTON’s exclusive written warranty.

5. ORTON Shower Enclosure 5-Year Limited Warranty

ORTON bath and shower enclosures are made of high-quality tempered glass, durable hardware, and are composed of finely shaped, heavy-gauge aluminum/stainless steel to ensure a lifetime of virtually worry and trouble-free use. Rich experience gives us the confidence to say that you will enjoy your orton bath or shower enclosure for many years to come. Your participating ORTON Dealer will repair or replace (at its discretion), any part of your shower or tub enclosure found to be defective in material or workmanship. Any parts found to be defective will be supplied free of charge FOB factory or designated service center.

Orton shower enclosure has a lifetime warranty on the glass and 5-year limited warranty on the hardware.

This warranty covers parts only, labor is not included.
This warranty does not cover mold or mildew that accumulates on silicone between glass panels or hardware through lack of proper cleaning.
This Warranty will not apply if, after inspection, it is determined that the shower door hinges have been installed and maintained in a manner that is not in conformity with the instructions and guidelines set forth by ORTON for proper installation and maintenance.
Orton’s responsibility to provide a remedy under this warranty shall be limited to either a refund of the purchase price, or to provide a replacement of a shower door hinge. The refund or replacement shall constitute the limit of ORTON’s liability and obligation for any material defect or defect in workmanship in a Shower Door Hinge.
This Warranty is exclusive, and ORTON makes no other warranty, express or implied, including without limitation, any implied warranty of merchantability or fitness for a particular purpose. In no event shall ORTON be liable under any legal theory (including but not limited to contract, negligence, strict liability in tort, or warranty of any kind) for any indirect, special, incidental, consequential, or exemplary damages (including but not limited to lost profits).
Our warranty is offered only to the original purchaser; that is, the warranty may not be assigned or transferred to someone else, and it terminates upon sale of the home/building in which the product has been installed. We do require proof of ownership.

To activate warranty, purchaser must contact orton for their shower door or tub enclosure within 30 days of purchase.To make a claim under the provisions of this warranty, simply contact your local Orton dealer.

6. ORTON Stainless Steel Kitchen Sink 1-Year Limited Warranty

Orton warrants its stainless steel kitchen, bar, and utility sinks to be free of defects in material and workmanship during normal residential use for as long as the original consumer purchaser owns his or her home. Gloss reduction, scratching, staining and acid or alkaline etching of the finish over time due to use, cleaning practices or water or atmospheric conditions, are not manufacturing defects but are indicative of normal wear and tear.

If a defect is found in normal residential use, Orton will, at its election, repair, replace or make appropriate adjustment. Damage caused by accident, misuse, or abuse, such as dents and scratches after installation, is not covered by this warranty. Improper care and cleaning will void the warranty. Proof of purchase (original sales receipt) must be provided to Orton with all warranty claims. Orton is not responsible for labor charges, installation, or other incidental or consequential costs. In no event shall the liability of Orton exceed the purchase price of the product.

If the stainless steel kitchen, bar, or utility sink is used commercially, Orton warrants the stainless steel sink to be free from defects in material and workmanship for one (1) year from the date the product is installed, with all other terms of this warranty applying except duration. All other components other than the stainless steel component carry ORTON’S one-year limited warranty unless otherwise specified.

ORTONAND/OR SELLER ARE PROVIDING THIS WARRANTY IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ORTONAND/OR SELLER DISCLAIMS ANY LIABILITY FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.

Some states/provinces do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of such damages, so these limitations and exclusions may not apply to you. This warranty gives the consumer specific legal rights. This warranty is to the original consumer purchaser only, and excludes product damage due to installation error, product abuse, or product misuse, whether performed by a contractor, service company or the consumer.

7. ORTON Vitreous China Toilet 3- 5 Year Limited Warranty

ORTON warrants to the original consumer purchaser of this product that Vitreous china Toilet will be free from defects in material and workmanship under intended use for as long as it is owned by the original consumer purchaser, or for commercial users, for five (5) years from the date of purchase.

ORTON warrants to the original consumer purchaser that all parts and components will be free from defects in material and workmanship under reasonable use for a period of ten (5) years from the date of original purchase. Toilet seats are warranted to the original consumer purchaser to be free from defects in material and workmanship for one (3) year from the date of purchase.

ORTON will repair or replace any product or parts thereof that proves, upon inspection by ORTON,to be defective in material or workmanship during the above stated periods of warranty coverage.If replacement of the original part is not practical, ORTON may elect to replace with an equivalent part or refund the purchase price in exchange for the return of the product. These are your exclusive remedies.

ORTON will not be liable for any labor, shipping, freight, or any other costs or charges incurred in connection with removal or replacement of the product or otherwise acting upon the above warranties, or for any costs associated with repair or replacement of any other personal property,building or installation materials. Installation or use of the product not in accordance with product instructions or improper use, abuse or neglect of, or accident to the product, or moving the product from the location of its original installation will void the above warranties. Use of in-tank bowl cleaners will void the warranty. Damage to the finish or performance of any components caused by the use of cleaning solvents/chemicals or improper cleaning methods,including in-tank bowl cleaners, will void the above warranties.

TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED TO THE STATUTORY PERIOD OR THE

DURATION OF THIS WARRANTY, WHICHEVER IS SHORTER.

ORTON SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LABOR CHARGES TO REPAIR, REPLACE, INSTALL OR REMOVE THIS PRODUCT), WHETHER ARISING OUTOF BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT,TORT, OR OTHERWISE. ORTON SHALL NOT BE LIABLE

FOR ANY DAMAGE TO THE TOILET RESULTING FROM REASONABLE WEAR AND TEAR, MISUSE, ABUSE, NEGLECT OR IMPROPER OR INCORRECTLY PERFORMED INSTALLATION, MAINTENANCE OR REPAIR, INCLUDING FAILURE TO FOLLOW

THE APPLICABLE INSTALLATION, CARE AND CLEANING INSTRUCTIONS.

The above warranties give you specific legal rights, and you may also have other rights locally. 8. ORTON Vitreous China Washbasin Lifetime Limited Warranty

All ORTON Vitreous China sinks will be covered by a limited lifetime warranty to be free of all manufacturing defects under normal use.

LIMITED SINK WARRANTY

ORTON will replace without charge, (excluding labor) any vitreous china sink supplied by ORTON., that is proven to be defective, with an equivalent replacement, within the specified appropriate period from date of purchase, to the original owner, provided it has been used solely in a residential application and installed in accordance with ORTON’S, installation instructions, used and cleaned as recommended, and not damaged due to abuse, misuse, or neglect. (In the event of a warranty claim, the owner will be required to provide proof of purchase – save sales receipt.)

The warranty will not cover any damages which might be caused by the product. Orton reserves the right to inspect any sink reported to be defective prior to replacement of the sink. All decisions are final. Replacement cost EXCLUDES transportation and any labor costs for the removal or reinstallation.

ORTON shall not be liable in case of:

– Improper installation/modification

– Damages resulting from abuse, such as a heavy impact or dropped objects

– Improper care or maintenance

– Improper applications (such as exposure to corrosive chemicals, photographic solutions, etc.)

– Any modification made to the product after it left ORTON’S premises

This warranty supersedes all other warranties, expressed or implied.

The foregoing warranties are exclusive and made only for the buyer. NO OTHER WARRANTY, WHETHER EXPRESSED, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE SHALL BE DEEMED TO EXIST IN CONNECTION WITH ANY OF THE GOODS OR SERVICES SUPPLIED HEREUNDER, AND ANY IMPLIED WARRANTIED FOR A PERIOD GREATER THAN THE WARRANTY PERIOD CONTAINED IN ORTON’S WARRANTY ARE HEREBY EXCLUDED. ORTON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES IN ANY WAY RELATED TO THE GOODS OR SERVICES SUPPLIED HEREUNDER. No employee, agent, or other person is authorized to give any warranties on behalf of ORTON, in addition to or different from the herein given to assume for Orton , any other liability in connection with any of its products except in writing which is signed by an officer of orton, and expressly and intentionally gives such warranties or assumes such liability.
